2.5. “User” means an individual or organization that completed account registration, accepted Terms, engaged with the Platform, or initiated/responded to requests.
2.6. “Platform Content” means all content the Company makes available on or through the Platform, including third-party licensed content, excluding User Content.
2.7. “User Content” means all Content submitted, posted, uploaded, published, or transmitted by Users, including photographs, profiles, descriptions, reviews, requests, personal information, messages, and payments. This excludes Platform Content and User Feedback.
2.8. “Care Services Locations” refers to specific places or facilities where Care Providers deliver services to Clients.

Certain Information, as specified in account settings, becomes visible in your public profile to other Users.
4.1.2.2. Information About Others: In certain situations, you may provide personal Information about others, including Care Recipients or family members' payment instruments. By providing such Information, you warrant possessing necessary authorization to disclose it and confirm you've shared our Privacy Policy with those individuals, who consented to its terms.
4.1.2.3. Address Book Contact Information: You may provide contact Information from your address book to facilitate easier connections within our Clients and Care Provider community.
4.1.2.4. Other Information: We collect additional Information based on your Platform interactions, including form data, account additions, survey responses, promotional participation, support communications, address book imports, geolocation sharing, and Feedback.

4.1.4.4. Payment Information: When payments are processed through our Platform, we may receive payment-related Information from third-party payment processors, including credit card information, bank account details, and transaction history.
4.1.4.5. Publicly Available Information: We may collect publicly available Information from public records or social media profiles to verify accuracy of User-provided Information.
4.1.4.6. Communication and Support: When contacting our customer support team or engaging through third-party platforms, we may collect Information about those interactions to address inquiries or resolve issues effectively.

5.2. User Verification: We use Information, including identity verification details and background checks, to confirm profile accuracy and establish community trust, ensuring User and Care Recipient safety and security.
5.3. Communication: We use contact Information for notifications, updates, service-related messages, and inquiry responses. We inform you about Platform enhancements, promotional offers, and relevant content, though you may opt out of promotional communications.
5.4. Data Sharing: We may, in certain circumstances, share Your Information with third parties for marketing and other purposes. By using our Services, you acknowledge and consent to such data sharing. We may share personal information with care agencies, hospitals, healthcare facilities, insurance companies, and other relevant entities.
5.5. Improvement of Services: We analyze User data to enhance Platform functionality, usability, and features, including aggregating and anonymizing data for statistical analysis and research.
5.6. Community and Support: Information facilitates Client-Care Provider community interactions, including User reviews and references. It enables us to address support requests, resolve disputes, and investigate and prevent fraudulent or inappropriate activities.

6.1.2. Listing Details: Care Providers create listings describing Care Services, availability, rates, and caregiving specialties. This Information is publicly visible to Clients, crucial for informed Care Provider selection.
6.1.3. Reviews and Ratings: Users may provide reviews and ratings about caregiving experiences. These reviews and ratings with associated comments are publicly displayed on Care Provider profiles.
6.1.4. Community Interaction: Information shared within community forums, discussion boards, or other interactive Platform features is publicly visible to other Users.
6.1.5. Messaging and Chat: When Users communicate through Platform messaging and chat features, conversation content is accessible to respective parties. Care should be taken avoiding sensitive personal Information sharing in these channels.
6.2. Service Requests
When a Client requests caregiving services, a structured and secure process ensures appropriate Information sharing between parties.
6.2.1. Request Initiation: The process begins when a Client identifies a Care Provider whose profile aligns with care needs.
6.2.2. Profile Information Exchange: Both Client and Care Provider may exchange relevant profile Information, including qualifications, caregiving experience, certifications, availability, and specific skills or specialties.
6.2.3. Scheduling and Availability: Information related to scheduling and availability is shared between Client and Care Provider, allowing schedule alignment.
6.2.4. Payment Information: Payment details, including agreed-upon Care Services rates, may be shared during service request processes.
6.2.5. Service Fulfillment Information Sharing: When a Client requests Care Services, specific necessary Information is shared between parties, including profiles, caregiving requirements, scheduling details, payment Information, and health Information about the Client or Care Recipient.
6.2.6. Privacy and Confidentiality: Client and Care Provider privacy and confidentiality are respected during service request processes. Personal contact Information like phone numbers and addresses typically is not shared until services request confirmation.
6.3. Sharing of Information For Legal Compliance
6.3.1. Legal Obligations: We may share User Information when necessary to comply with legal obligations from applicable laws, regulations, court orders, or government authorities.
6.3.2. Law Enforcement Requests: In response to valid law enforcement requests, we may disclose User information, including profiles, transaction records, and communications.

6.4.3. Information Shared for Checks: To facilitate background checks, we share necessary information with third-party service providers, which may include Care Provider name, contact information, and government-issued identification details.
6.4.4. Privacy and Security: We prioritize User Information privacy and security. Information shared with third-party background check providers is done with utmost care and security measures.
6.4.5. Results and Eligibility: Background check results determine Care Provider eligibility to offer Caregiving Services on our platform.
6.4.6. Transparency: We are committed to background check process transparency. Care Providers are informed of screening requirements and consent to undergo checks when joining our Platform.
6.4.7. Other Third-Party Services: Beyond background checks, we may engage other third-party service providers for payment processing, identity verification, training, insurance, and customer support.
6.4.8. Data Protection: We take data protection seriously, ensuring third-party providers adhere to strict data security and privacy standards.
6.4.9. User Control: Users have control over Information shared with third parties, including during background checks.
6.4.10. Legal Compliance: We share information with third parties per applicable laws and regulations, ensuring User Information protection.
6.5. Business Transfers And Reorganization
6.5.1. Business Transition: In mergers, acquisitions, asset sales, or other business transfers, User Information may transfer to third parties or successor entities as transaction parts.

8.2. While Users may share healthcare-related information with Care Providers on our Platform, it is essential to understand the Platform is not HIPAA-compliant, and we do not have infrastructure to fully secure protected health information (PHI) per HIPAA standards.
8.3. Users are solely responsible for shared healthcare-related information, medical records, or personal medical data privacy and security on the Platform.
8.4. The Platform does not assume HIPAA obligations or responsibilities. Users should not rely on the Platform for HIPAA-compliant communication or data storage.
8.5. If Users require HIPAA-compliant communication or healthcare-related information storage, they should seek and use appropriate platforms or services complying with HIPAA regulations.
8.6. Users should exercise caution and discretion sharing healthcare-related information with Care Providers on the platform, considering information sensitivity and Platform limitations.
8.7. The platform does not provide medical advice, diagnosis, or treatment. Any shared healthcare-related information is for informational purposes only and should not replace qualified healthcare professional consultation.
8.8. The Platform does not establish doctor-patient or healthcare provider-patient relationships. User communications or interactions are not considered medical consultations or services.
8.9. While the Platform employs reasonable data security measures, users should be aware that shared healthcare-related information is not subject to HIPAA PHI protection levels.
8.10. Users are responsible for complying with applicable laws and regulations concerning healthcare information privacy and security.

Any dispute shall be governed by Texas State laws, without regard to any jurisdiction's conflicts of law provisions. To the extent that any lawsuit is permitted under this Agreement, you expressly consent to the personal and exclusive jurisdiction and venue of the state and federal courts located in Texas for any lawsuit.
